What is a court marriage?

“Court marriage” is the common name for a marriage that is solemnised or registered before a government Marriage Registrar instead of only through a religious ceremony. It gives you a legally valid marriage certificate – needed for a passport, visa, bank nomination, insurance, property and a spouse’s legal rights. In Ahmedabad, couples usually marry under one of two routes:

Special Marriage Act, 1954Hindu Marriage Act, 1955 (with registration)
Who can use itAny two persons, any religion – including inter-religion and foreign nationalsBoth parties Hindu, Buddhist, Jain or Sikh
CeremonyBefore the Marriage Officer; no religious rites neededReligious ceremony (e.g. Arya Samaj or temple), then registration
Notice period30-day public notice before solemnisationNo notice period for the ceremony; registration follows
Typical timeAbout 30–45 daysOften completed within a few days

Marriages solemnised under personal law in Gujarat are also registered under the Gujarat Registration of Marriages Act, 2006. We advise which route is right for your situation, religion and urgency.

Love marriage and police protection

Adults have a constitutional right to marry a person of their choice. If a couple faces threats from family after an inter-caste or inter-religion marriage, we help with representations to the police and, where necessary, a petition before the High Court of Gujarat seeking protection.

Can we do a court marriage without our parents’ consent?
Yes. Parental consent is not legally required for adults. The groom must be 21 or older and the bride 18 or older, and both must consent freely.
How many witnesses are needed for a court marriage?
Three witnesses are required under the Special Marriage Act. Witnesses must be adults and carry ID and address proof.
Can an inter-religion couple marry without converting?
Yes. The Special Marriage Act, 1954 allows persons of different religions to marry without either party converting.

Yes, under the Special Marriage Act. The foreign partner needs a valid passport and visa, and usually a No Objection or Single Status Certificate from their embassy, and the residence requirement must be met by one party.
Is a court marriage certificate valid abroad?
Yes. A certificate issued by the Marriage Registrar is legal proof of marriage and is accepted for visas and immigration, often after apostille by the Ministry of External Affairs.
