Family Lawyer in Ahmedabad

Family disputes are personal, emotional and often urgent. Advocate Chandan R Rajput represents husbands, wives and parents before the Ahmedabad Family Court in maintenance, child custody, domestic violence, divorce and other matrimonial matters — with the sensitivity these cases need and the firmness they sometimes demand.

Family law matters we handle

  • Maintenance – for wife, children and dependent parents under Section 144 BNSS (earlier Section 125 CrPC), Section 24 and 25 of the Hindu Marriage Act and the Hindu Adoptions and Maintenance Act, 1956.
  • Child custody and visitation – under the Guardians and Wards Act, 1890 and the Hindu Minority and Guardianship Act, 1956.
  • Domestic violence – applications and defence under the Protection of Women from Domestic Violence Act, 2005: protection, residence, monetary relief and custody orders.
  • Divorce – mutual consent and contested.
  • Restitution of conjugal rights – Section 9 of the Hindu Marriage Act.
  • Judicial separation and annulment of void and voidable marriages (Sections 10, 11 and 12 HMA).
  • Dowry and cruelty cases – defence and complaints, and settlement of cross-cases.
  • Stridhan recovery and return of articles.
  • Execution of maintenance orders – recovery of arrears through attachment, salary deduction or warrant.

The Ahmedabad Family Court

The Family Court in Ahmedabad is set up under the Family Courts Act, 1984 and hears divorce, maintenance, custody, guardianship and other matrimonial disputes for the city. The Act encourages conciliation, so most cases are first referred for counselling or mediation. Our approach is to use this stage seriously – many disputes are resolved faster and more cheaply there – while preparing fully for trial in case settlement fails.

Maintenance: what the court looks at

Under the Supreme Court’s directions in Rajnesh v. Neha (2020), both parties must file an affidavit disclosing their assets and liabilities. The court then considers:

  • the income and earning capacity of both spouses;
  • the reasonable needs of the wife and children and their standard of living during the marriage;
  • the husband’s other liabilities and dependants;
  • whether the wife is working – earning some income does not automatically disqualify her.

Child custody: the welfare of the child comes first

Indian courts decide custody on the welfare of the child, not on the rights of either parent. The court looks at the child’s age, emotional bonds, education, stability of each home, and the child’s own wishes if old enough. The parent without custody normally receives visitation rights, and in suitable cases joint or shared custody is ordered.

Domestic violence cases

A woman facing physical, verbal, emotional, sexual or economic abuse in a domestic relationship can seek protection orders, residence orders, monetary relief and custody under the DV Act. Equally, we defend husbands and relatives against exaggerated or false DV applications, including seeking deletion of relatives who never lived in the shared household.

Frequently asked questions

How long does a maintenance case take in Ahmedabad?
Interim maintenance is often decided within a few months of filing. The final order may take longer depending on evidence. The court can order maintenance from the date of the application.
Can a working wife claim maintenance?
Yes. A wife’s qualifications or modest earnings do not automatically bar maintenance. The court compares both incomes and the standard of living she enjoyed in the matrimonial home.
Who gets custody of a child after divorce?
Custody depends on the welfare of the child. Young children are often placed with the mother, but a father can be granted custody if it is in the child’s best interest. The other parent usually gets visitation rights.
What can be done if maintenance is not paid?
An execution application can be filed in the Family Court. The court can attach property, direct deduction from salary, or issue a warrant for recovery of the arrears.
What is restitution of conjugal rights?
Under Section 9 of the Hindu Marriage Act, if a spouse withdraws from the other’s company without reasonable excuse, the aggrieved spouse can ask the court to order them to return to the matrimonial home.
