Criminal Lawyer in Ahmedabad

Arrest, a police complaint or a summons can turn your life upside down overnight. Advocate Chandan R Rajput defends clients in criminal matters across Ahmedabad — from the first hour after an FIR to bail, trial and appeal — before the Metropolitan Courts at Ghee Kanta, the City Civil & Sessions Court at Bhadra and the High Court of Gujarat.

Criminal defence from FIR to final judgment

In a criminal case the first few days decide a great deal. What you say to the police, whether you apply for anticipatory bail in time, and how your first bail application is drafted can shape the entire case. Our role begins the moment you call: we assess the FIR or complaint, explain the sections applied, tell you honestly where you stand, and act quickly to protect your liberty.

Since 1 July 2024, criminal cases in India are governed by the Bharatiya Nyaya Sanhita (BNS), the Bharatiya Nagarik Suraksha Sanhita (BNSS) and the Bharatiya Sakshya Adhiniyam (BSA), which replaced the IPC, CrPC and Evidence Act. Offences committed earlier are still tried under the old laws. We handle cases under both regimes and know which provisions apply to your matter.

Criminal matters we handle in Ahmedabad

  • Regular bail and anticipatory bail – applications before the Magistrate, Sessions Court and High Court of Gujarat (BNSS sections 480, 482 and 483; earlier CrPC 437, 438 and 439).
  • FIR quashing – petitions before the High Court of Gujarat where the FIR is false, a civil dispute dressed up as a crime, or settled between the parties.
  • Matrimonial criminal cases – cruelty and dowry complaints (BNS 85/86, earlier IPC 498A), Dowry Prohibition Act cases and related offences against husbands and in-laws.
  • Cheating, fraud and breach of trust – property, business and investment fraud complaints, defence and prosecution.
  • Cheque bounce – complaints and defence under Section 138 of the Negotiable Instruments Act at the Ghee Kanta courts.
  • Cyber crime – online fraud, harassment, morphed images, and unfreezing bank accounts frozen on cyber cell requests.
  • Serious offences – assault, theft, robbery, NDPS, POCSO and murder trials at the Sessions Court.
  • Criminal appeals and revisions – against conviction or acquittal before the Sessions Court and High Court.

What to do if you are named in an FIR

  1. Get a copy of the FIR. FIRs in Gujarat are usually available online on the Gujarat Police citizen portal, or we can obtain it for you.
  2. Do not give written statements or sign anything before speaking to your lawyer.
  3. Check whether the offence is bailable. For bailable offences bail is a right; for non-bailable offences an application must be argued.
  4. Consider anticipatory bail if arrest is likely. Applying early often avoids custody altogether.
  5. Preserve your evidence – WhatsApp chats, call records, bank statements, CCTV, emails. Electronic records are admissible under the BSA when properly certified.

How a criminal case moves through Ahmedabad courts

After investigation the police file a charge-sheet (police report) before the Metropolitan Magistrate. Offences triable by a Magistrate stay at the Metropolitan Courts at Ghee Kanta; serious offences are committed to the City Civil & Sessions Court at Bhadra. The court frames charges, the prosecution leads evidence, we cross-examine its witnesses, the accused’s statement is recorded, defence evidence follows and the court delivers judgment. Bail, discharge and quashing remedies are available at different stages, and choosing the right one at the right time is where an experienced criminal advocate makes the difference.

Frequently asked questions

How quickly can bail be filed in Ahmedabad after an arrest?
A bail application can usually be filed the same day or the next working day after arrest, once the FIR and remand details are available. For bailable offences bail is granted as a right; for non-bailable offences the application is argued before the Magistrate or Sessions Court.
What is anticipatory bail and when should I apply?
Anticipatory bail (Section 482 BNSS, earlier Section 438 CrPC) is protection from arrest granted before arrest. Apply as soon as you have a reasonable fear of arrest in a non-bailable case – it is filed before the Sessions Court or the High Court of Gujarat.
Can a false FIR be quashed?
Yes. The High Court of Gujarat can quash an FIR under its inherent powers (Section 528 BNSS, earlier Section 482 CrPC) if it discloses no offence, is malicious, is essentially a civil dispute, or has been settled between the parties in certain offences.
Which court will hear my criminal case in Ahmedabad?
Most cases start before the Metropolitan Magistrate Courts at Ghee Kanta. Serious offences triable by a Court of Session go to the City Civil & Sessions Court at Bhadra. Bail appeals, quashing petitions and criminal appeals go to the High Court of Gujarat at Sola.
Do the new criminal laws (BNS, BNSS) apply to my case?
The BNS, BNSS and BSA apply to offences committed on or after 1 July 2024. Offences committed before that date continue under the IPC and CrPC. Your advocate will check the date of the alleged offence and the sections applied.
Can you help unfreeze a bank account frozen by the cyber cell?
Yes. We assist with representations to the cyber cell and the bank, and where needed, applications before the competent court for release of the frozen amount, with transaction proofs, bank statements and the complaint number.
